Commercial Leases — Drafting, Review and Negotiations

Tenant Law

Commercial Lease contracts can be long, complex and confusing, but it is important to get them just right to preserve the landlord and the tenant’s rights. An improperly drafted commercial lease could result in unexpected and bad results for either the landlord or the tenant. We have represented both landlords and tenants in commercial lease negotiations  for many types of commercial properties: strip shopping centers, outparcels in malls and large shopping center developments, office buildings, industrial developments, mixed-use developments, etc.  Our broad experience in drafting and negotiating commercial leases with some largest commercial landlords in the country has proved to be invaluable for our clients (both landlords and tenants).

Evictions/Unlawful Detainers

State law provides certain protections for tenants. Landlords must follow a specific protocol under the law if they want to evict a tenant or otherwise prevent a tenant from unlawfully occupying a property (unlawful detainer). The same is true if a tenant wants to fight an eviction. Certain requirements must be met, and you may need to show that the landlord did not meet his or her requirements for a proper eviction as well.

Litigation for Landlords

The most common type of litigation that a landlord undergoes is to evict a tenant. Each requirement must be followed to a tee in order to have a valid eviction. Then, evidence of meeting these requirements is presented to the court. Litigation can also come up in other areas as well, such as with state or local regulators or through discrimination claims. Litigation for Tenants

Litigation for tenants often revolves around the payment of rent, but it can also come up when your landlord is not fulfilling their part of a commercial rental agreement. Maintenance, paying utilities, and complying with local laws can be hot button issues for tenants.

Landlords may have to deal with citations that allege that the property is not in compliance with state, county, city or zoning codes. In this type of situation, you may need to go before an administrative body to argue that your property does meet the code or determine what you need to do to be in compliance. This often includes the local housing authority or department.

Foreclosure Eviction and Defense

There are situations where the landlord does not pay their mortgage even though their tenant has been diligently paying their rent. In this type of situation, tenants have rights and cannot be immediately forced out of their homes. A landlord/tenant lawyer can help assert your rights in this confusing time.

State and Federal Appeals

When you have lost your case at the lower level, you may have the opportunity to appeal it either within the state or at the federal level. Appeals have entirely different legal rules compared to the initial case, so these situations can be very complicated.
